NZI plans to remove entirely the employer assisted post-study work visa. Currently, graduates can apply for this visa when offered employment in a role that applies to their chosen studies. NZI plan to issue 1, 2 and 3-year open work visas to graduates of level 4-8 courses. The time granted is dependent on the qualification level and whether the applicant intends to work in Auckland or not. There are additional changes to the ability to sponsor partners and children on these work visas. In general, these changes are positive ones for the applicants as INZ takes action to address its target of higher level educated immigrants. As mudanças nas leis de imigração da Nova Zelândia, anunciadas pelo Ministro de imigração Michael Woodhouse, entrarão em vigor no dia 14 de agosto de 2017. Como estas mudanças poderão afetar os planos de quem está vindo para NZ estudar, trabalhar ou com planos maiores de conseguir a residência no país?

Meu objetivo é de apresentar algumas ideias simples em algumas das mudanças nas leis de imigração para a Nova Zelândia do meu ponto de vista. As mudanças em si, o que foi introduzido, retirado ou modificado, eu acredito que todo mundo já tenha uma boa ideia, se não segue o link para busca.

Estudos:

No momento ainda não foram anunciadas nenhuma mudança neste setor, no entanto, as mudanças anunciadas nas leis de imigração para o visto de trabalho (utilizando as habilidades essenciais) e de residência (utilizando o Skilled Migrant Category-SMC) afetarão os planos de muita gente. As pessoas diretamente influenciadas serão as que apostaram ou estão pensando em apostar na qualificação através de estudos no país como uma possibilidade de se conseguir um visto de trabalho numa profissão até então denominada de ‘Skilled’, a fim de se conseguir pontos para a residência. Agora com as mudanças propostas que entrarão em vigor em 14 de agosto, quando o estudante se graduar na profissão denominada, como de habilidade essencial, terá então mais um desafio: o de conseguir um trabalho que pague o salário anual exigido pela imigração de $48,859 para que sua profissão seja considerada como sendo de habilidade essencial (essential skilled) e ganhar os pontos que ajudarão no somatório para obtenção da residência.

Trabalho:

As mudanças neste setor estão relacionadas à categoria de habilidades essenciais (Essential Skills).

Serão introduzidos dois tetos salariais: o de $48,859 e o de $73,299 para que a profissão seja considerada como sendo de habilidade essencial no país.

O primeiro teto salarial de $48,859 NZD:

Está relacionado às profissões qualificadas através de estudo ou experiência e que estão em demanda no país ocupando posição de 1 a 3 no sistema de classificação utilizado pela Nova Zelândia e Austrália (ANZSCO 1-3) onde o profissional teria que ganhar no mínimo $48,859 ao ano para então conseguir um visto de trabalho utilizando a categoria de habilidade esssenciais em demanda no país (essential skills work visa). Se a oferta de trabalho tiver então um teto salarial de $48,859 ($23.49 a hora) isto significa que o profissional terá direito aos pontos para residência e de trazer a família, onde o companheiro(a) teria o direito a visto de trabalho e os filhos em idade escolar teriam o direito a acesso escolar gratis.

E se o seu trabalho pagar abaixo deste valor anual?

Se o salário não atingir esta marca sendo inferior, o trabalhador estará automaticamente trabalhando numa profissão considerada de baixa ”qualificação/habilidade” e consequentemente o trabalhador não terá o direito aos pontos para a residência e o parceiro ou parceira e filho(s) em idade escolar não terão respectivamente o direito a visto de trabalho e estudos. No entanto, o parceiro ou parceira e filho(s)poderão ficar na Nova Zelândia com visto de visitante ou aplicar para outro visto como o de trabalho ou estudo, mas por conta própria.

Redução da duração do visto de trabalho:

Uma outra mudança proposta que gostaria de comentar é a redução do tempo de visto de trabalho para trabalhadores em profissões consideradas de baixo “qualificação/habilidade”, a duração máxima do visto seria de 3 anos e, após este período, o trabalhador não poderia aplicar para outro visto de trabalho processo que ocorre atualmente. Nesta nova lei, após 3 anos trabalhando na Nova Zelândia, o trabalhador só poderia aplicar para outro visto depois que um determinado período de tempo transcorresse.

Segundo teto salarial $73,299 NZD:

Uma notícia boa no sistema de remuneração para classificar profissões como pertencentes à categoria de habilidades essenciais para o país, foi a introdução do teto salarial de $73,299 ($35.24 a hora) onde profissionais de qualquer profissão que ganhem este valor anual, serão então considerados como ocupando profissão na categoria de habilidades

essenciais para o país. Isto significa que estes profissionais depois que a lei passou a vigorar também poderão reivindicar pontos para a residência.

E se seu trabalho pagar acima deste valor anual?

Uma outra boa notícia anunciada relacionada a remuneração é que se o seu salário médio anual for de $97,718.00, você ganhará então pontos extras, na sua aplicação para residência utilizando a SMC.

Este teto salarial é fixo e definitivo?

Não. A base salarial será revisada anualmente de acordo com a base salarial média do país. Então, se seus planos são de conseguir pontos para residência baseado em seu salário melhor ficar bem informado e de olho nas mudanças.

Quem sao os maiores beneficiados com estas mudanças?

Estas mudanças irão favorecer principalmente a profissionais ainda jovens e altamente qualificados. Conta-se com o aumento da pontuação para profissionais de formação universitária com pós-graduação (mestrado, doutorado) e que possuem experiência de trabalho nas áreas de formação profissional listadas na categoria de habilidades essenciais para o país ANZSCO de nível 1-3. Outros beneficiados direto são os profissionais bem pagos que ganham acima de $73,299 anual.

If elected Labour plans to cut immigration by 20,000 to 30,000. This means fewer work visas, fewer student visas and certainly less residency visa.

Currently, a Labour government looks unlikely to happen with National showing an increase in popularity and Labour a decrease in popularity.

So, let's take a look at what could be driving such a radical position and what factors are at play here in NZ in relation to immigration.

Firstly as mentioned Labour are going into the election on the back foot and potentially they will need something radical to potentially wake up a voting sector. Radical statements such as cutting 30,000 immigrants a year will certainly do that.

What is this argument for less immigration potentially based on?

1. HOUSING

It is no secret that Auckland housing is becoming less and less affordable for the typical Kiwi home buyer.

2. JOBS FOR KIWIS

Another argument for cutting immigration is that it will protect NZ workers.

However, Once you look beneath the surface both these arguments are not as clear cut as Labour may have us believe.

Immigration is one of many factors pushing up Auckland house prices. Foreign investors (not within NZ) are a factor as is the migration from Christchurch to Auckland. The shortage of skilled labour in the construction sector is also inflating labour rates. Many skilled workers arriving in NZ that labour intends to cut are not in a financial position to buy in Auckland anyhow.

Regarding employment, it is significantly easier for an NZ employer to employ a worker within NZ. The skilled migrant work scheme is far more complex and costly process for the employer compared to recruiting locally. Additionally, the employer must prove they have exhausted the local recruitment possibilities. It’s safe to assume by the time the employer needs to recruit externally that in fact there are no Kiwis for that position. This is an argument that is near impossible to dispute within sectors such as hospitality and construction.

Final thoughts! Whilst any rapid increase in the population such as that Auckland is experiencing will stress the city logically and in some ways economically it brings within it a better future and in the case of NZ a very much needed one. As an Aucklander who has watched this city change over that last decades, it is obvious that this recent wave of immigration is shaping NZ for the better. Let's hope it continues.

According to an industry group, the construction industry will need another 30,000 workers within just the next two years. Civil Contractors New Zealand (CCNZ) stated that not enough people were being attracted to the construction sector which was expected to grow by 4.7 percent, twice the national job growth rate by 2019.

This boom in demand is driven by two large consumers of construction talent. Firstly the Christchurch earthquakes and subsequent rebuilds are draining local talent and secondly the Auckland property and population boom is creating unprecedented levels of construction in New Zealand's largest city.

This pressure on the NZ labour markets is creating an opportunity for skilled workers to enter NZ under the essential skills programme. The essential skills work visa programme covers many sectors but certainly construction is a significantly active one.

According to the Business, Innovation and Employment Ministry forecasts, one in five new jobs created between 2016 and 2019 would be in construction,

Statistics NZ figures recently showed that almost 80 percent of construction firms reported vacancies last year.

New Zealand is hungry to attract skilled professionals in this current environment of strong economic growth.
